Recruitment Management Systems Workplace Agreements Declaration

 

At Jez Consulting we endeavour to keep our fees as competitive as possible to enhance the likelihood of working with clients to provide them with contemporary solutions to their business needs.

Jez Consulting shall not commence delivery of any services to a client until both parties have agreed to the details of any contract.

All information supplied to a client by Jez Consulting is provided on a strictly confidential basis and may not be disclosed to any unauthorised third party without prior consent. Jez Consulting treats all information supplied to us by clients as strictly commercial-in-confidence.

Jez Consulting will hold the Intellectual Property Rights for all of its systems and models.  Systems models and information are provided to clients for an agreed fee on the understanding that clients will not give, sell or pass on any part of the systems, manuals or information to any other party; nor consult any other agencies on the implementation of these systems without prior written approval from the Principal of Jez Consulting.

However, clients may allow Government Departments, Authorised Bodies, and their own customers or staff to view and examine the systems or models as part of that client’s normal day to day activities.

Successful project completion often depends heavily on the effective cooperation of the clients' staff. Ensuring that existing systems are incorporated within the systems and models provided by Jez Consulting, and that any changes are only introduced if absolutely necessary as a vital element of the proposed system.  It is also imperative that the client's staff understand, and have a sense of ownership, of any systems being developed that have a direct bearing on them.  To achieve this Jez Consulting may, from time to time, require access to selected staff during the course of a project.

All data and information sources used by Jez Consulting in any recommendations or reports are made in good faith and based on the information available to us at the time. Therefore, no verbal statement and no statement in any letter or report is to be deemed to be in any circumstance a representation, warranty or undertaking or contractual condition or guaranteed success.

Jez Consulting endeavours to maintain contact with clients for follow-up visits/calls after the completion of a project to ensure that the Quality Management Systems developed for the client are being maintained and providing benefits to the client.  Any charges related to such services are negotiated as and when required.

Fees charged relate to all consulting services provided by Jez Consulting as outlined in any proposed project or assignment, and include all time spent on the said project or assignment, whether at the clients’ premises or elsewhere.  Any additional costs and other out-of-pocket expenses such as writing of Interim Reports, provision of additional documents, advertising, airfares, accommodation, excess travel, etc. (if applicable) are not generally included in the contract price.  Said costs will be charged at the casual rate (as indicated below), unless otherwise confirmed by the Principal of Jez Consulting.  No variation to our guarantee or fee structure is valid unless confirmed in writing by the Principal of Jez Consulting.

An individual client's Terms of Engagement for Jez Consulting's services are as per the details contained in each client’s proposal, contractor/consultant agreement or contract.

The fees in any proposal put forward by Jez Consulting are valued for six months from the date of commencement of project.  Fee rates are subject to adjustment in accordance with the consumer price index for assignments exceeding six months in duration.

The aim of Jez Consulting is to provide clients with Systems that will allow them to achieve their goals as soon as possible.  We will always endeavor to deliver timely completion of a project, however when there is a need for any negotiations to occur or information to be supplied to Jez Consulting, it will generally be the responsibility of the client, and their staff, to achieve timely completion of their responsibilities.

Once Jez Consulting has completed a project, the on-going adherence to any systems is the responsibility of the client and their staff.

Payment.

The fees in any proposal put forward by Jez Consulting are valued for six months from the date of presentation of that proposal. Fee rates are subject to adjustment in accordance with the consumer price index for assignments exceeding six months in duration.

*It is difficult to be specific about the time,and therefore costs involved in the preparation of any new Systems or Models.  Project fees are based on providing services as described in the agreed 'Outline of Service', in which the parameters of the project are set.  Project fees will always be considerably less than Casual rates being applied to the same amount of time.

After the completion of a project, where appropriate, Jez Consulting endeavors to maintain contact with clients via follow-up visits and calls to ensure that the systems developed for the client are being maintained and are actually providing benefits to the client. Any charges related to such services are negotiated as and when required.

Recruitment Referral Conditions and Guarantee

Terms and Conditions - Permanent Appointments

  1. Unless amended in writing and signed by the Managing Director of Jez Consulting, all referrals or resumes are submitted to companies under the following terms and conditions:
  2. Fees for permanent appointments cover services including (but not limited to) identifying, interviewing, reference checking, qualification verification, testing (where necessary) and short-listing suitable applicants.
  3. Fees for part time positions will be pro-rata amount of fee for full time position paying same hourly rate.
  4. Fees for appointments in Retainer/Commission based positions will be calculated on the Retainer component only.
  5. Rates and conditions for Temporary Staff available upon request.
  6. 5% discount for persons under 18 and/or without 6 months practical experience.
  7. 2% discount from total invoice if paid within 7 days.
  8. Provided always that a minimum placement fee of $300 is payable.
  9. Special rates available for exclusive or semi-exclusive listings.
  10. Jez Consulting's' telephone and/or resume referrals are made to companies on behalf of the individual applicants with the express permission and authorisation of said applicants including indication that such express permission and authorisation to contact a specific company was not given to any other agency and that direct individual contact has not been made. Delivery of resume and/or telephonic contact with the company by Jez Consulting constitutes first applicant-authorised contact and such resumes and/or referrals may be cancelled by the company only if cancellation is documented by source and date of previous contact, and only if cancellation is made before any interview between the applicant and company has been arranged by Jez Consulting.
  11. All information, whether written or verbal, supplied by Jez Consulting is confidential and should not be disclosed to any other party without the express written consent of Jez Consulting.
  12. Jez Consulting referrals and/or resumes are in force for a period of 90 days after initial presentation to the client. A full fee will be due to Jez Consulting if an applicant is employed by the company in any capacity during that period.
  13. Advertising and any other out of pocket expenses will be paid for by the client, and they are considered due and payable immediately upon invoicing from Jez Consulting. All advertising will be submitted for client authorisation before placing in the approved publication. Said authorisation will also be deemed to be the client's expressed agreement that Jez Consulting shall hold copyright ownership of all advertising placed by Jez Consulting.
  14. The client agrees not to approach for the purpose of employment any person introduced by Jez Consulting to the client in the course of its staff consultancy services for a period of 90 days from either the date of introduction to the client of such person by Jez Consulting, or the date of cessation of any temporary assignment by such person with the client, whichever occurs later, in breach of which a placement fee will be payable to Jez Consulting in accordance with the fee structure current as at the date of such breach.
  15. While endeavouring to ensure that all applicants are tested and reference checked as far as is practical, Jez consulting does not accept liability for any loss or damage of any kind whatsoever caused by any act, neglect, dishonesty or default on the part of such applicants.
  16. When Jez Consulting is contracted by a client to secure an appointee to a permanent position a service fee will be charged, calculated as a percentage of the placement fee otherwise payable, at the sole discretion of Jez Consulting if:-
    The client withdraws instructing once the contract has commenced;
    The requirements of the position are significantly changed once the contract has commenced;
    The client appoints an applicant to the position not introduced by Jez Consulting.

**AR = Annual Remuneration: Total salary, shift allowances, penalty rates and value of special benefits such as company car (valued at $8,000 per annum), superannuation and other allowances which are conditions of the job specifications.  Overtime is not included in AR. Unless standard requirement of the job.  Where commissions or bonuses are part or all remunerations package, commissions/bonuses will be calculated at minimum standard to the position.

*All rates exclusive of G.S.T.

Guarantee

If invoice is paid in full, the following guarantee will apply.

This guarantee may be invoked by the client if:-

  1. The appointee voluntarily ceases their employment during the guarantee period.
  2. The client, during the guarantee period, reasonably considers the appointee not to be satisfactory, in relation to the stated requirements of the position.
  3. Jez Consulting is given immediate notice of cessation of employment and the subsequent requirement for a replacement.

Jez Consulting guarantee requires that: 

Jez Consulting shall have exclusive right to supply applicants for replacement for a period of 1 month from cessation of employment.  The original fee will be adjusted if the replacement is at a higher or lower salary.

The cessation of employment during the guarantee period is not due to the restructuring of the job description or redundancy or redeployment caused by the client.

If the guarantee is invoked and invoice has not been paid, payment must be made at time of invoking guarantee.

Note: This guarantee is null and void unless invoice for original placement is paid within 30 days of the invoice date.

Terms and Conditions - Temporary Appointments

  1. Unless amended in writing and signed by the Principal Consultant of Jez Consulting, all referrals and appointees are submitted under the following terms and conditions.
  2. These conditions shall form part of the terms of engagement between the client and Jez Consulting and shall be exclusive of all other matters to be implied relating to the construction of such terms of engagement save and except for any agreement in writing between the client and the Principal Consultant of Jez Consulting respectively to vary these terms of engagement.
  3. All information, written or verbal, supplied by Jez Consulting is confidential and should not be disclosed with any other party without the prior express written consent from the Principal Consultant of Jez Consulting.
  4. Jez Consulting will invoice all conditions, bonuses, meal, vehicle or other allowances and entitlement in accordance to the relevant Award or Agreement at cost, plus 25% to cover associated on-costs.
  5. All relevant Award or Agreement conditions apply to Temporary Staff supplied by Jez Consulting, and the client will be invoiced accordingly. Clients will be invoiced, and employees paid, based on the working hours shown on the Jez Consulting timesheet. The client will ensure that each timesheet is authorised by an appropriate person.
  6. Jez Consulting in accordance with the relevant Award, Agreement or Contract will invoice overtime or shift work. An additional 20% loading fee may be added to the hourly rate in circumstances where the supplied staff will not be entitled to payment, by the client, of accumulated benefits and entitlements.
  7. The hourly rates invoiced to clients, including allowances, are for all related on-costs eg: Sick Pay, Workers Compensation Insurance, Payroll Taxes, Superannuation, Training etc. Jez Consulting undertakes the responsibility for PAYE tax and issue of Group Certificates.
  8. All rates are dependant on job classifications, relevant Awards, and any special conditions. These rates and conditions are subject to change without notice when affected by any Award or Agreement variations or any statutory on-costs.
  9. Any client authorised travel during work hours will be invoiced by Jez Consulting at the hourly rate, plus kilometre allowance, designated by the appropriate Award, Agreement or Contract.
  10. The client agrees not to approach for the purpose of employment any person introduced by Jez Consulting to the client, subsidiary, affiliated or related company, in the course of its services for a period of six months from either the date of introduction to the client of such person by Jez Consulting, or the date of cessation of any assignment by such person with the client, whichever occurs later. Any such action would be considered a permanent placement and would be invoiced by Jez Consulting at the appropriate rate as outlined in Jez Consulting's Schedule of Fees.
  11. The client shall provide all necessary equipment and machinery to enable the staff member provided by Jez Consulting undertaking any position to properly and safely perform the duties of such position and the client acknowledges that it is the sole responsibility of the client to provide a safe working environment.
  12. Jez Consulting shall not be responsible for any absences from the employment of the client of any person due to any cause whatsoever including, but not limited to sickness, industrial dispute/s or accident.
  13. All Jez Consulting employees are assigned under the care, control and supervision of the client and the client is responsible for all acts, errors and omissions of Jez Consulting employees be they wilful, negligent or otherwise for the duration of the assignment.
  14. If a client is in any way unhappy with the Temporary Staff person supplied by Jez Consulting no fee will be charged, provided Jez Consulting is notified within four hours of commencement of the assignment.
  15. In the event of an assignment being cancelled or postponed Jez Consulting will pay the employee and invoice the client for any appearance fees, etc. that are required by the relevant Award or Agreement.
  16. Jez Consulting is to be provided with no less than One Days notice on the cancellation or postponement of any individual Jez Consulting employee's assignment.
  17. While endeavouring to ensure, through reference checking, testing and qualifications verification, that all Jez Consulting appointees are qualified to standard of skill claimed, Jez Consulting does not accept liability for any claim for loss or damage of any kind whatsoever caused by any act of negligence, lack of skill, dishonesty or default on the part of Jez Consulting's appointees.
  18. Payment terms are strictly payment in full, within 7 days of the issuing invoice against weekly payment of wages and all statutory costs paid to Temporary Staff by Jez Consulting.

Management Systems

Payment.

Successful implementation of any Quality Management System is dependent not only on proving compliance with all areas of the documented Quality System or particular standard that may apply, but also demonstrating on-going adherence to the system or standard. Once Jez Consulting has established the Quality Management Systems required the on-going adherence to the system is the responsibility of the clients' staff.

* Based on Desk-Top audit being completed within 2 weeks of agreed date.  If, for reasons other than any attributable to Jez Consulting, the Desk-Top audit is not completed within 2 weeks of agreed date, this amount will become due and payable immediately.

Once Jez Consulting has completed a project, the on-going adherence to any systems is the responsibility of the client and their staff.

Achieving ISO:9000 series Certification is dependent not only on proving compliance with all areas of your compliant and documented Quality System, but also demonstrating on-going adherence to that system. Once Jez Consulting has established the Quality Management Systems required, the on-going adherence to these systems is the responsibility of the client and their staff.

At all times the main priority held by Jez Consulting is the resourcing of its clients with Quality Business Solutions!

Achieving ISO:9000 series certification requires being audited against a set of 'Quality Procedures' (that have been developed in line with the requirements of the ISO:9000 series Standards, any Industry Standards that may apply, and any existing Policies of an organisation), and demonstrating a history of compliance and adherence to those procedures. 

Our aim at Jez Consulting is to provide Clients with Quality Solutions/Management System that allow them to achieve their goals as soon as possible.

 

Workplace Agreements

The aim of Jez Consulting is to provide clients with Systems that will allow them to achieve their goals as soon as possible.  We will always endeavour to deliver timely completion of a project, however when there is a need for 'negotiation' to occur is the responsibility of the client, and their staff, to achieve successful resolution.  Once a project has been completed, the on-going adherence to any systems supplied by Jez Consulting is the responsibility of the client and their staff.

Payment.

The fees in any proposal put forward by Jez Consulting are valued for six months from the date of commencement of project. Fee rates are subject to adjustment in accordance with the consumer price index for assignments exceeding six months in duration.

* Project fees are based on providing services as described in the attached 'Project Outline', in which the parameters of the project are set.  Project fees will always be considerably less than Casual rates being applied to the same amount of time.  At this stage it is extremely difficult to be specific about the time,and therefore costs involved in the preparation of your Enterprise Agreement, and it's ultimate approval by the Australian Industrial Relations Commission.  This fee is an estimate only, based on providing approximately 1 week of service to perform only those services recommended earlier, and pending reaching final agreement on the parameters of the Project in question.

After the completion of a project Jez Consulting endeavors to maintain contact with clients via follow-up visits and calls to ensure that the systems developed for the client are being maintained and are actually providing benefits to the client. Any charges related to such services are negotiated as and when required.

 

Our Declaration

Jez Consulting appreciates that, as with any profession, it is absolutely essential to maintain the highest level of ethical standards.

Jez Consulting prides itself on the high standards of professional and personal ethics we demonstrate when providing service to our clients. To this end we have developed the standards below which outlines the code of ethical practice that shall be adhered to by Jez Consulting when delivering services to our clients.

We declare that:

We respect the confidentiality and commercial value of any information we have about our client, and realise the potential harm of disclosing this to others. We will treat all information about clients as strictly confidential.

*        The anonymity of our clients will be maintained at all times during the provision of services, and for a further 12 months thereafter, unless otherwise arranged.

*        Any potential conflicts of interest that may arise will be disclosed to our clients prior to agreeing to undertake any brief.

*        At all times we will endeavour to provide flexible, progressive solutions to meet the very individual needs of our clients.

*        Will maintain regular contact with our clients while working on any briefs on their behalf.

*        We will ensure that all of our Terms of Business, and any Special Conditions, are fully understood and agreed to by a potential client prior to commencing a brief.
